It is specified that these Terms and Conditions are exclusively for the sales of ART GIRONA products presented on art-girona.com. These products are sold new. These conditions will be apply to the exclusion of all the other terms and conditions, including those in force in the showroom ART-GIRONA.
ARTICLE 1 – PRICE
1.1 – The prices of our products are indicated in euros all taxes included, excluding processing fees and shipping. (See Shipping / time and cost).
1.2 – ART GIRONA reserves the right to update the prices at any time but the products will be billed based on rates in effect at the time of order entry.
1.3 – The products remain the property of ART GIRONA until the moment full payment is received by ART GIRONA.
1.4 – The products sold on art-girona.com are reserved for individuals.
ARTICLE 2 – ORDER
Orders are placed on the Internet: art-girona.com.
Contractual information is presented in English and will be confirmed with the contractual information at the latest at the time of delivery. ART GIRONA reserves the right to cancel or refuse any order from a customer in case there is a dispute over payment of a previous order.
ARTICLE 3 – VALIDATION
You acknowledge having read and accepted these terms of sale before placing your order. The validation of your order implies acceptance of these Terms and Conditions Unless proved otherwise, the data recorded by art-girona.com constitute proof of all transactions made by art-girona.com and its customers.
ARTICLE 4 – AVAILABILITY
Our product offers and prices are valid until they are visible on the site, within the limits of available stocks. For products not stocked in our warehouses, our offers are subject to availability from our suppliers. In this framework, information on availability of products are provided at the time of placing your order. This information comes directly from our suppliers, errors or omissions may exceptionally exist. In the event of unavailability of final product after placing your order, we will inform you by email or by mail upon receipt of the information received from suppliers. Your order will be automatically cancelled and you will be immediately refunded if your bank account has been debited.
ARTICLE 5 – DELIVERY
5.1 General
The conditions of transport of products purchased in art-girona.com, cost’s and time of each delivery area (“Shipping and delivery” calculated automatically by the shopping cart site). The times indicated in the item description are average times of usual treatment plus delivery times are based on the delivery area. The products are delivered to the delivery address you specified during the ordering process. When you order multiple products at the same time and they have different shipping times, shipping time control is based on the longest time. ART GIRONA however, reserves the right to divide shipments into several parts. Only products shipped are then debited. The participation fee for processing and shipping will be charged for one shipment. ART GIRONA is not held responsible for any consequences due to delayed delivery. In case of delayed shipment an email will be sent. In this case as long as the product is not shipped, you can always cancel your order, except the cases when the shipment is ready to be delivered. In case of delayed delivery when the product has been shipped, you can cancel your order and request a refund of the product and the cost of return. In this case, if you receive the product after your cancellation, we will refund the product upon receipt thereof, complete set and with its original condition.
In case of payment by credit card, the times indicated are average times and correspond to the time of shipment (on record), plus delivery times according to the delivery area.
5.2 – Delivery Problems
In accordance with commercial practice the goods travel at the risk of the recipient. The recipient is the owner of the goods from the start of our premises. It is therefore the recipient to verify the driver about the condition of the equipment upon receipt. If the driver does not wait for unpacking, do not give him the signed receipt, but do follow by mail. In case of damage, please note the nature of your concerns explicitly on the carrier’s receipt and confirm the claim within 2 days by registered letter with acknowledgment of receipt to the carrier. If claims are not made in these forms, the carrier can not be held responsible and can not be redeemed equipment.
ARTICLE 6 – PAYMENT
The payment of your purchases can be made:

ARTICLE 7 – REDEMPTION
Refunds for products in the cases referred to in Articles 5 and 8 will be made within less than or equal to 10 days after receipt of the goods by us. Reimbursement will be made at the discretion of ART GIRONA by crediting your account or if it’s possible nullifying the banking operation. No shipment against delivery will be accepted for whatever reason.
ARTICLE 8 – MONEY BACK
8.1 – You have 10 days from receipt to return the product if it does not suit you. The shipment and return will be at your expense. Only the price of the product purchased will be refunded. The present right of return will be accepted for products in their original condition and complete (packaging, accessories, manuals…), in good condition and accompanied by a copy of the invoice. Items returned incomplete, damaged or soiled by the customer will not be refunded.

ARTICLE 13 – WARRANTY
13.1. Legal rights
We are committed to your choice, refund or exchange products apparently defective or does not match your order. If you request a refund, please kindly contact our sales department. Products must be returned to us in store or reported the condition in which you received them with all the elements (accessories, packaging, manuals…).

This contract is subject to Spanish law. The language of this contract is in English language. In case of dispute with professionals and / or traders, the courts of Girona (Spain) will be competent. In case of dispute, the Spanish courts will have exclusive jurisdiction.
